Fair work ombudsman eyeballs sham contracting

A recent Federal Court of Australia decision again shows that the Fair Work Ombudsman (FWO) has sham contracting arrangements in its sight, especially when such arrangements are an attempt to avoid legitimate employer obligations to employees.

A recent decision of the Federal Court of Australia determined the primary judge denied the appellant procedural fairness and allowed an appeal after considering the primary judge was wrong to dismiss a matter. The primary judge concluded there was an abuse of process in the appellant’s claim and she had been discriminated against after being denied the presence of a sign language interpreter to assist her husband with communication during the birth of their child.

Parliament listens to road haulage contractor drivers’ concerns

Segments of the road haulage industry have been up in arms in recent weeks over the Contractor Driver Minimal Payments Road Safety Remuneration Order 2016 (RSRO) which is now in operation nationally despite a recent short term stay ordered by the Federal Court of Australia.
