Hicksons has extensive commercial dispute resolution expertise. We focus on providing these services to the insurance industry, financial institutions, government agencies and businesses. More than half of the firm’s lawyers service clients in these sectors.

Headed by partner Rod Cameron, Hicksons has a highly experienced team which includes partners Paul Hendriks and Dr Tim Channon who are Accredited Specialists in Commercial Litigation and Chris Moore a former barrister. Our involvement in commercial claims ranges from simple contract disputes to complex high profile insurance and commercial matters such as the Sydney Airport 'third runway' litigation. Critical to our success is the ability to put together the right team with the requisite experience for any particular case. That experience ranges from securities and banking issues through complex IT issues to agricultural loss management and everything in between.

Our no-nonsense and practical approach to commercial disputes, no matter how complex or large, is to support clients in making early, informed assessments of risk by highlighting the core legal and commercial issues. This includes assessing the suitability of alternative dispute resolution (ADR), including mediation, arbitration, informal negotiation and conciliation to achieve timely, acceptable and certain results. We continue to assess the suitability of ADR techniques right throughout the litigation process.

Ancillary to this work we also have extensive experience acting for commercial clients in coronial and special enquiries. We have advised clients called before the Independent Commission Against Corruption (ICAC), Special Commissions of Inquiry and the Australian Crime Commission. We  have acted in numerous high profile cases in this context, including the inquiry into the fire on board the HMAS Westralia.

However when litigation presents as the best (or in some cases the only) option, we will protect our clients’ interests with a robust and comprehensive strategy. Our team is at home in all commercial legal arenas, with successes at all levels of the legal process, including the High Court. Our approach to litigation is to thoroughly prepare all aspects of the case, with an emphasis on both the evidence gathering process and face-to-face contact with witnesses at an early stage. For clients who are subject to model litigant protocols, we are fully cognisant with and able to apply these requirements whilst at the same time prosecuting firmly to ensure the best possible outcomes.
