The Front Comor - An Australian Perspective on the European Court of Justice Rebuff to the English Anti Suit Injunction

In August 2000 the Front Comor collided with its charterer’s oil jetty at Syracuse, Italy.  The charterer’s insurers paid the charterers a sum in excess of €15.5 million under the insurance policy and then commenced court proceedings in Italy against the owners of the Front Comor claiming the amount they had paid to the charterers.  The charterparty of the vessel contained a London arbitration clause.

European Court Rebuffs The House of Lords - The Front Comor

On 10 February 2009 the European Court of Justice (ECJ) handed down its eagerly awaited decision on the legality of English anti-suit injunctions which have in recent years become a favourite tool of the English courts to support London arbitrations. 

An anti-suit injunction is an order of the Court preventing a party from proceeding with a claim in another jurisdiction in breach of contractual provisions requiring the parties to resolve their disputes in London arbitration or in the English courts.
